On October 24th, FDA issued warning letters to 29 companies manufacturing, marketing or distributing products made from cherries or other fruits. These letters told the firms to stop making unproven claims on the firms’ websites and product labels that their fruit products treat or prevent disease. The companies were cited for marketing dried fruit, fruit juice and juice concentrate for treating or preventing a variety of diseases, including cancer, heart disease and arthritis. FDA warned that if these companies fail to take prompt corrective measures, they could face FDA enforcement action without further notice. Actions could include FDA seizure of the products, as well as injunctions or criminal sanctions.
In other developments, FDA recently took action against several firms marketing unapproved “alternative hormone therapies” because the products these firms are selling are unapproved new drugs that have not been found safe and effective to treat or prevent certain serious or life-threatening diseases or conditions. The agency issued 16 warning letters to 16 dietary supplement and hormone cream marketers making un-proven claims that tout the benefits of their alternative hormone therapy products in treating or preventing serious
diseases, including cancer, heart disease and osteoporosis, and in affecting the structure or function of the body. The marketers were given 15 days to respond to FDA.
