Aker BioMarine has obtained Australian Innovation Patents No. 2012101332, 2012101333, 2012101334 and 2012101335 containing claims covering krill oil compositions currently being sold in Australia, as well as extraction of krill oil from denatured krill products (e.g., a krill meal or a powder). None of the granted claims are limited to krill oil extracted by any specific extraction method.
Innovation Patents are a particular patent variety available only in Australia. They provide 8-year protection for inventions that are novel over the prior art, and where the novelty-conferring feature substantially contributes to the function of the invention, but there is no inventive step requirement as for ordinary patents. Granted Innovation Patents are not enforceable until thoroughly examined by the Australian patent office, a process that was successfully concluded for all four patents on November 6th.
